DUI Criminal Case

The DUI criminal case begins immediately after a person has committed the crime of driving under the influence.  This crime is committed when a person drives a motor vehicle while under the influence of 1) drugs 2) alcohol; or both.  It is also committed when a person drives a motor vehicle with a blood alcohol concentration of 0.08% or higher.  Once a person violates either of these laws, law enforcement can arrest the person and then charge him/her with DUI.

Immediately following a person’s arrest, he/she will be brought into a police station for booking.  At this time, it is advisable that people contact an experienced DUI defense attorney who can provide them with insight and direction throughout the phases of the criminal process, which has already commenced.  A DUI defense lawyer can review the person’s charges, investigate police procedures, and help the person make beneficial decisions that will positively impact their case outcome.

Following booking is the arraignment.  At the arraignment, the person will make his/her plea (guilty, not guilty, or no contest), and the terms of the person’s bail will be set.  In many cases, following the arraignment, the person’s defense attorney can negotiate with prosecutors to have the person’s charges reduced or even dismissed.  If the prosecutor and defense lawyer can reach an agreement that the person is content with, the case will not proceed to trial.  However, if a mutual agreement cannot be reached, the case will proceed to trial.

Once a case proceeds to trial, a judge will have to determine if the person is to be found "guilty" or "not guilty".  If the person is found guilty, he/she may be sentenced with a variety of severe legal penalties, which may include:   jail time, fines, community service, probation, DUI school, and/or court ordered counseling.
