Blood/Breath Test

When a person is suspected of driving under the influence in California, he/she will be asked to submit to chemical testing in the form of a breath or blood test.  These tests are used to determine a person’s blood alcohol concentration (BAC), which is believed to directly correspond with a person’s level of intoxication.  The higher the person’s BAC is, the more intoxicated they are believed to be.  For example, if one person has a BAC of .02%, and another person has a BAC of .10%, the person who has the .10% BAC is considered more intoxicated.  Blood alcohol concentration shows how much alcohol is in a person’s blood stream. 

After a person has been stopped by law enforcement for DUI, he/she will be asked to consent to a voluntary breath alcohol test.  It is important to remember that the person has the right to refuse to take the breath test.  If the person refuses to take the test, law enforcement will usually arrest the person for DUI, and then have the person take a blood or breath test at the police station.  If the person consents to the breath test, and his/her test result is 0.08% or higher, he/she will be arrested for DUI.

Even though blood and breath tests are highly regarded by law enforcement and prosecutors for accuracy, these tests are not 100% accurate.  There are many factors that can lead to a false BAC test result.  For this reason, people should always hire a DUI defense attorney who can thoroughly investigate their BAC test results and the procedures surrounding the test administration.  In some cases, a lawyer may be able to discover test errors or inaccuracies that could lead to reduced or dismissed criminal charges.
